Beware of Email Jury Scams

Do not give out personal information via email warned the federal courts Thursday. A new juror email scam has been reported in over a dozen federal court districts, the July 31 bulletin said.

The email scam targets citizens, informing them they have been selected for jury duty and must return a completed form. The bogus form requests information such as Social Security, driver's license and cell phone numbers, as well as a victim’s date of birth and mother's maiden name, the Administrative Office of the U.S. Courts warned.

The scam, which falsely claims to be affiliated with eJuror, goes on to say that those who do not respond will have to explain their actions to the court, and could even face fines and jail time. EJuror is an online registration program that approximately 80 district courts use

"Ex-IRS official Lois Lerner’s crashed hard drive has been recycled, making it likely the lost emails of the lightning rod in the tea party targeting controversy will never be found, according to multiple sources," Politico's Rachael Bade reported Wednesday evening.

Although the revelation has congressional Republicans understandably furious and at least one prominent IT expert trashing the IRS's digital documents-retention policy as "mind-boggling", the Big Three broadcast networks all ignored the latest developments in the IRS saga on their Thursday evening newscasts, even as they had time for Harrison Ford's broken leg (NBC), a new technology for police car chases (ABC), and comedian Tracy Morgan's car accident (CBS).

Email marketing is three times more effective than social media. Really?

Burkey Belser (@burkeybelser), a pioneer in legal services marketing and branding, wrote this week that email outperforms social media by three to one.

I hate to break it to all the Facebook and LinkedIn marketers because this revelation is so uncool, but email marketing outperforms social media three to one according to almost everyone including Buffer. Sure, you hate spam but buyers have honed their email skills to recognize destructible spam (hit ), while they might still take a peek at spam that might have value (you know who you are!). Just because “your” habits are not “theirs” and “they” are not “you” does not mean everyone shares your point of view.

You Need a Duty to Preserve Before Issuing Sanctions - Bow Tie Law Blog

In a case where the Court called the Defendants’ disclosures troubling, the Plaintiffs sought sanctions for the failure to back-up hard drives or issue a litigation hold.

There was one big problem with the Plaintiffs’ argument: they did not prove that the Defendant had a duty to preserve the email when it was destroyed. Magnuson v. Newman, 2013 U.S. Dist. LEXIS 138595, at *44 (S.D.N.Y. Sept. 25, 2013).

The Court stated the earliest the Defendants could have been on notice of the duty to preserve was on August 18, 2010, when they were served the original complain. Magnuson, at *45. Additionally, the Defendants had a three-month email retention policy. Id.

The Court of Appeals for the Tenth Circuit recently shed light on an increasingly common Internet business practice. In 1-800 Contacts, Inc. v. Lens.com, Inc., a panel of the court held that the use of a competitor's trademark to trigger a paid advertisement is unlikely to constitute trademark infringement, provided that the text of the advertisement does not contain the competitor's mark. This decision establishes that, in most circumstances, a company may engage in the practice of keyword advertising by using another company's trademark for the purpose of boosting its own website traffic.

This case involves two competing contact lens retailers. The plaintiff, 1-800 Contacts, owns the federally registered trademark 1800CONTACTS. 1-800 Contacts monitors third party use of the 1800CONTACTS trademark by searching for its mark via the Internet search engine Google. In 2005, 1-800 Contacts noticed that paid ads for defendant Lens.com started appearing among the search results. Significantly, Lens.com never incorporated 1800CONTACTS into the actual text of its sponsored links.
