N.K. (a minor) and JODY LUECK, Plaintiffs,

Bullying is an extremely serious problem in our country, and it has grown in both scope and visibility in recent years. With the advent of social networking sites, bullied children often find themselves without the benefit of a safe harbor. Not only must they be on guard at school, but also now at home, where there are digital portals—computer, tablet, and phone—to yet more ridicule. The national media has covered the issue extensively, after several horrifying incidents ultimately led to suicide.
After a thorough review of the evidence, which included the use of a Facebook page to post various insults, the Court concluded that St. Mary's did not act with deliberate indifference. Therefore, it granted their motion for summary judgment on the Title VI and Title IX claims.
Since the Court granted summary judgment on the Title VI and Title IX claims, it found lack of jurisdiction over the state law claims and therefore, dismissed them without addressing the merits.
All claims in this matter having been disposed of, the case is hereby DISMISSED.
