Homeland Security Secretary Utterly Ignorant of Fourth Amendment !!!


If we needed proof that some people in the federal government don't understand (nevermind follow)he Constitution, wepresent the exampl(link is external)e of Jeh Johnson, Secretary of the Department of Homeland Security:

Johnson, a man with sweeping power to invade the property rights and privacy of every American using judge-less warrants to search and seize records, has a Fourth Amendment problem: He doesn’t really know it.
As reported at Mediaite(link is external), Senator Rand Paul grilled Secretary Johnson at a hearing about government’s obtaining records from telephone companies without a warrant, which seems on its face to violate the Fourth Amendment:
“Right off the bat, Paul, a 2016 presidential candidate, asked Johnson if he believes the Fourth Amendment ‘applies to third party records,’ specifically those of telephone companies. Johnson said that question is ‘beyond my competence as secretary of homeland security’ to answer intelligently.”
Wow. As Mark Fitzgibbons notes, "Apparently, ignorance of the law is an excuse if you run a massive federal bureaucracy with sweeping police state powers."

BAD NEWS FOR #OBAMA AMNESTY AT APPEALS COURT ! @Breitbart

There were few positive signs for the White House Friday as President Barack Obama’s latest executive actions on immigration were debated in front of a federal appeals court.
During more than two hours of oral arguments before the 5th Circuit U.S. Court of Appeals in New Orleans, Obama’s own statements about his immigration moves were used by a Republican-appointed judge to put a Justice Department lawyer on the defensive.
And the sole Democratic appointee on the three-judge panel repeatedly argued for the legality of the president’s actions by turning to an argument that the administration fears could discourage illegal immigrants from applying for programs that offer them quasi-legal status and work permits.
By the time the court session wrapped up, it appeared likely the appeals judges will rule, 2-1, against the administration’s request for a stay of a district court injunction barring Obama from going forward with an expansion of a program offering quasi-legal status to illegal immigrants who came to the U.S. as children and with a new program offering the same benefits to illegal immigrant parents of U.S. citizens.

The American freedoms of religionspeechpress and assembly as protected and practiced were new to the world. Those contributions to the world’s political thought were uniquely American. So it is with the concept of federalism. The establishment of multiple layers of government with divided sovereignty over the same territory each responsible for different aspects of life was a unique American development as well.
Dictionary Definitions of Federalism Do Not Reflect American Federalism
According to Merriam-WebsterFederalism is the distribution of power in an organization (as a government) between a central authority and the constituent units. The Free Dictionary defines the term as: A system of government in which power is divided between a central authority and constituent political units.
The dictionaries speak of divided authority, but fail the mention the key to American Federalism. The American Constitution, uniquely in history divided “sovereignty”.1 By consent of the people “sovereignty” over subject matter was divided among governmental units.
The Declaration of Independence outlined the Natural Law basis for the legal establishment of the United States. Natural Law begins with a sovereign individual that for his own benefit grants certain aspects of his sovereignty to society.

1stt Amendment to the #Constitution: #Freedom of Religion


The first ten amendments to the US Constitution are referred to as the Bill of Rights.  The First Amendment protects “freedom of expression” for Americans by restricting government authority to pass laws interfering with the freedoms of religion, speechpress and assembly.  A fifth right, to petition the government for redress of grievances, is listed, but the citizenshave allowed it to be taken from them.  The first freedom protected in the First Amendment is religion.
It is fitting that protection of religious liberty from government interference is America’s “first freedom”. Many of the first North American colonists were motivated by a search for religious liberty.
Duty of 17th Century Civil Authorities to Save Souls
Seventeenth century European religious persecution arose from the belief, held by Protestants and Catholics, that a society must have religious uniformity since there was only a single true religion.  Civil authorities had a duty to impose the single true religion by force if necessary in the interest of saving the souls of all citizens.  Heretics might be executed and nonconformists were granted no mercy.

Natural #Law and the Legitimate Authority of the #UnitedStates

Declaration of IndependenceGovernment needs a basis to exercise authority over people. Citizens must accept government authority.  A government lacking acceptance of the people over whom it exercises authority will not endure.  Such acceptance comes from fear, tradition or philosophy.
Dictators obtain authority by instilling fear of disobedience in the populace. A theocracy ordained by God arises from religious traditions.  A monarchy combines religious traditions[1] and fear of the monarch’s absolute authority. Communists have gained power with a philosophy based upon the “dictatorship of the proletariat”.[2]  The United States was founded upon a philosophy of Natural Law as the source of legitimate legal authority for government.
Government by Philosophy:  Understanding, Acceptance & Consistent Conduct
For a government founded on philosophy to maintain its authority, three things are needed:
  1. An understanding by the people of the philosophy
  2. An acceptance by the people of the philosophy
  3. Conduct by the government consistent with the philosophy

Law Firm Facebook Pages Are Lame

Somewhere out there a social media consultant must be blogging about how important it is to have a Facebook page for your law firm, because “Follow my firm’s Facebook page!” updates seem to pop up in my feed every day or two. That consultant is a moron.
I’m sure there are law firms out there somewhere that are earning all kinds of media or pulling in tons of potential clients from its Facebook page, but that doesn’t mean everyone should do it.

Following the massacre of grammar-school children in Newtown, Conn., in December 2012, high-powered weapons have been used to kill innocent victims in more senseless public incidents. Those killings, however, are only a fragment of the total harm caused by the misuse of firearms. Each year, more than 30,000 people die in the United States in firearm-related incidents. Many of those deaths involve handguns.

Progressives are wrong about the essence of the Constitution
In a 2006 interviewSupreme Court Justice Stephen Breyer said the Constitution is “basically about” one word — “democracy” — that appears in neither that document nor the Declaration of Independence. Democracy is America’s way of allocating political power. The Constitution, however, was adopted to confine that power in order to “secure the blessings of” that which simultaneously justifies and limits democratic government — natural liberty.
The fundamental division in U.S. politics is between those who take their bearings from the individual’s right to a capacious, indeed indefinite, realm of freedom, and those whose fundamental value is the right of the majority to have its way in making rules about which specified liberties shall be respected.
