WASHINGTON — Stepping into a heated debate within the nation’s intelligence agencies, President Obama has decided that when the National Security Agency discovers major flaws in Internet security, it should — in most circumstances — reveal them to assure that they will be fixed, rather than keep mum so that the flaws can be used in espionage or cyberattacks, senior administration officials said Saturday.
But Mr. Obama carved a broad exception for “a clear national security or law enforcement need,” the officials said, a loophole that is likely to allow the N.S.A. to continue to exploit security flaws both to crack encryption on the Internet and to design cyberweapons.

Report: NSA exploited Heartbleed for years

SHARE 106 55 3COMMENTMORE
The Heartbleed security flaw that exposes a vulnerability in encryption has reportedly extended its reach well beyond Web services.
According to Bloomberg, citing "two people familiar with the matter," the National Security Agency knew about Heartbleed for at least two years and used the hole in encryption technology to gather intelligence.
Bloomberg also says Vanee Vines, an NSA spokeswoman, did not provide comment.
This follows a separate Bloomberg report the security flaw impacts Android smartphones and tablets that run the 4.1.1 version of the Google operating system.

WASHINGTON — American officials have long considered Huawei, the Chinese telecommunications giant, a security threat, blocking it from business deals in the United States for fear that the company would create “back doors” in its equipment that could allow the Chinese military or Beijing-backed hackers to steal corporate and government secrets.

But even as the United States made a public case about the
dangers of buying from Huawei, classified documents show
that the National Security Agency was creating its own back
doors — directly into Huawei’s networks.

NSA top lawyer says tech giants knew about data collection

Nevermind the vociferous denials from tech titans like Google, Microsoft, and Apple. They knew the government was collecting their user data, the NSA's general counsel says.

NSA pretended to be Facebook to infect millions of computers

As part of its efforts to install malware on “millions” of computers worldwide, the National Security Agency impersonated Facebook to trick targets into downloading malicious code.
“In some cases the NSA has masqueraded as a fake Facebook server, using the social media site as a launching pad to infect a target’s computer and exfiltrate files from a hard drive,” reports The Intercept in its latest expose based on top-secret documents obtained by Edward Snowden.

N.S.A. Director Says Snowden Leaks Hamper Efforts Against Cyberattacks

WASHINGTON — Gen. Keith B. Alexander, the director of the National Security Agency, said Tuesday that the leaks by the former agency contractor Edward J. Snowden had slowed the effort to protect the country against cyberattacks on Wall Street and other civilian targets.

General Alexander was speaking at a conference at Georgetown University in one of his last public speeches before he leaves the agency this spring. He predicted that the disclosure of information relating to government surveillance programs would force Congress to act on changes to the rules governing the bulk collection of telephone records before it tries again to pass legislation that would mandate the way private companies protect against cyberintrusions, and delineate what information they share about attacks with the government.

Report: American Law Firm's Communications Spied On

, Legal Times

Revelations on Saturday that an American law firm's communications with a foreign government client were monitored by a National Security Agency ally may provide new impetus for the U.S. Supreme Court to revisit a 2013 decision that involved electronic surveillance law.

The justices, if they wish, have a vehicle for reconsidering their 5-4 decision in Clapper v. Amnesty International USA. The Center for Constitutional Rights last month filed a petition for review asking the high court to hear their challenge to surveillance by the NSA in light of Edward Snowden's revelations about the extent of the surveillance program.

NSA targeted WikiLeaks, Pirate Bay, leaked documents show

The latest revelations suggest that the US and UK singled out certain Web sites for surveillance, according to a report from The Intercept, which published classified documents.

The National Security Agency and the UK's Government Communications Headquarters targeted WikiLeaks and Pirate Bay -- and ultimately users of those sites as well, according to leaked files.
Examining a series of classified documents leaked by whistle-blower Edward Snowden, news site The Intercept reported on Tuesday that the NSA wanted to deem WikiLeaks a "malicious foreign actor." Such a designation would have subjected the site to extensive surveillance without the use of "defeats," an NSA action that aims to prevent US citizens from getting snared in the surveillance.

With the power invested in the NSA why be suprised to who they would target?

The have carte blanche to spy on anyone, and no one is stopping them, and that probably will continue for the foreseeable future.

Despite Protest, The USA Freedom Act Remains In Holding Pattern

Feb 17, 2014

Coming off a day of global protest — both offline and off — that sent tens of thousands of emails and phone calls into the United States Congress, it appears that the USA Freedom Act hasn’t budged on Capitol Hill. According to The Hill, the bill is stuck fast. Despite the recent protests dubbed “The Day We Fight Back” that argued in favor of the Act, Congress… Read More

Tech Circuit: Spies & Trolls Edition

Will SCOTUS Revisit NSA? Are Universities Patent Trolls?
, Law Technology News

The tension between privacy and security seems to be escalating by the minute. (It certainly was front-and-center at LegalTech New York.) Saturday, The New York Times reported that another top-secret document, obtained by former National Security Agency consultant Edward Snowden, "shows that an American law firm was monitored while representing a foreign government in trade disputes with the United States."
"The disclosure offers a rare glimpse of a specific instance in which Americans were ensnared by the eavesdroppers, and is of particular interest because lawyers in the United States with clients overseas have expressed growing concern that their confidential communications could be compromised by such surveillance," wrote James Risen and Laura Poitras. Speculation is that the affected firm is Chicago-based Mayer Brown, which represented the Indonesian government, they reported.

Why would anyone think that law firms, lawyers or other legal professionals were (are) immune from NSA's ubiquitious eyes?  That is simply silly.

NSA protest results in tens of thousands of phone calls, emails

Organizers of The Day We Fight Back, a protest Tuesday against U.S. National Security Agency surveillance programs, called the effort a “tremendous success,” with nearly 100,000 phone calls made to U.S. lawmakers and 185,000 people signing up to send email blasts to their congressional representatives.
Participants in the protest made 96,000 calls to Congress, although 7,000 of those calls weren’t delivered because lawmakers turned voice mail services off, organizers said. Organizers will deliver 555,000 email messages protesting the NSA surveillance to lawmakers, with emails going to the two U.S. senators and one representative who represent each of the 185,000 people who signed up for the email blasts.

Americans love our freedom but we value our privacy highly as well.  It's find the balance between these two that can be difficult so we aren't we trying?

A legal challenge to the National Security Agency’s telephone data surveillance program by Senator Rand Paul was followed by a dispute between two high-profile Republican lawyers over authorship of the complaint.
Constitutional lawyer Bruce Fein wrote the complaint and was replaced as its author by Kenneth Cuccinelli, the former attorney general of Virginia, according to Fein’s spokeswoman.

Can the NSA Really Send a Drone to Bomb Your Phone?

The world woke up Monday morning to yet more unsettling news about how the NSA is spying on people. This time, though, the repercussions are deadly.
It turns out the NSA is helping the military carry out lethal drone strikes using electronic surveillance, namely from unreliable cell phone data.
More specifically, the NSA uses geolocation data to track the SIM card or cell phone of potential targets and it then uses that data to kill them. A former drone operator for Joint Special Operations Command (JSOC) toldThe Intercept that the process is inherently flawed because top Taliban leaders have figured out the United States is using geolocation data from cell phones and regularly swap SIM cards or switch phones. This means that the drone strikes don't necessarily hit their intended targets but rather friends, family members, or even unsuspecting strangers who managed to get ahold of the tracked phone. The former drone operator said that innocent people had "absolutely" been killed as a result of this oversight.

White House rejects review board finding that NSA data sweep is illegal

The White House on Thursday disputed the findings of an independent review board that said the National Security Agency's mass data collection program is illegal and should be ended, indicating the administration would not be taking that advice.
"We simply disagree with the board's analysis on the legality of the program," White House Press Secretary Jay Carney said.
He was responding to a scathing report from The Privacy and Civil Liberties Oversight Board (PCLOB), which said the program ran afoul of the law on several fronts.

And BIG BROTHER knows best!
