Lawrence Joyce, an Illinois voter who has objected to Cruz’s placement on the Illinois primary ballot next month, will have his case heard in the Circuit Court of Cook County in Chicago. Joyce’s previous objection, made to the state’s Board of Elections, was dismissed on February 1. He appealed the decision and was granted a hearing for Friday before Judge Maureen Ward Kirby.

Joyce challenges Cruz’s right to be president in the wake of questions put forth by GOP rival Donald Trump about being born in Canada. Cruz maintains he is a natural-born citizen since his mother is American-born.

Shortly after presidential contender Donald Trump said it would happen, a businessman in Texas has filed a lawsuit to challenge Senator Ted Cruz’s eligibility to be placed on the ballot.

Bloomberg News report:

Republican presidential contender Ted Cruz should be disqualified from the race because he isn’t a “natural-born citizen,” a fellow Texan claims in a “birther” challenge filed against the senator in a U.S. court.

The suit seeks a court definition of the term to clarify whether Cruz — who was born in Canada to an American mother — can or can’t serve if elected.

“This 229-year question has never been pled, presented to or finally decided by or resolved by the U.S. Supreme Court,” Houston attorney Newton B. Schwartz Sr. said in his 28-page complaint. “Only the U.S. Supreme Court can finally decide, determine judicially and settle this issue now.”

This isn’t the first time a lawsuit like this has been filed. The most recent challenges filed stem from John McCain’s run for president. McCain was born in the Panama Canal Zone that was later determined to be U.S. Soil.

Ted Cruz was born in Calgary, Alberta, Canada in 1970 and moved to Texas in 1974. While Cruz’s mother was a United States Citizen (his father was a Cuban citizen), she had to file paperwork at a Canadian embassy to recognize the birth and his citizenship.

Since Ted Cruz was born abroad and had to request the government recognize his citizenship, it is arguable that Cruz is not a “Natural Born Citizen” as the Constitution requires of a president.

The lawsuit and entire “birther” debate has the pro-Cruz camp up in arms.

National Review wrote:

Let’s get the first thing out of the way: Yes, Ted Cruz is eligible to be president. If you’re one of the quarter of Republicans who think that the circumstances of Cruz’s birth are somehow disqualifying, or the 26 percent that haven’t made up your minds, please: Read this. Or this. Or maybe this. Or this. For God’s sake, The Atlantic is clear that this is nonsense. So either the Republican party has several million heterodox constitutional scholars in its midst, or a hefty chunk of the party has devoted itself, with single-minded zeal, to being intentionally, flamboyantly ignorant. Which brings us to Donald Trump. This is, of course, his doing. Because he is unable to engage Cruz (or anyone else on stage) on matters of actual substance, he’s mongered conspiracy under the pretext that Democrats were going to do it anyway. It doesn’t seem to matter to Trump or to his supporters that his legal opinion on the subject was wildly different just four months ago.

While the National Review was quick to redirect readers to a few articles that brush off the controversy, the matter is far from unsettled.

The respected Heritage Foundation has covered this and while they conclude that “a majority of “commentators” argue in favor of the eligibility of Cruz, the argument is “much less certain.”

Under the longstanding English common-law principle of jus soli, persons born within the territory of the sovereign (other than children of enemy aliens or foreign diplomats) are citizens from birth. Thus, those persons born within the United States are “natural born citizens” and eligible to be President. Much less certain, however, is whether children born abroad of United States citizens are “natural born citizens” eligible to serve as President. As early as 1350, the British Parliament approved statutes recognizing the rule of jus sanguinis, under which citizens may pass their citizenship by descent to their children at birth, regardless of place. Similarly, in its first naturalization statute, Congress declared that “the children of citizens of the United States, that may be born beyond the sea, or out of the limits of the United States, shall be considered as natural born citizens.” 1 Stat. 104 (1790). The “natural born” terminology was dropped shortly thereafter. See, e.g., 8 U.S.C. § 1401(c). But the question remains whether the term “natural born Citizen” used in Article II includes the parliamentary rule of jus sanguinis in addition to the common law principle of jus soli. In United States v. Wong Kim Ark (1898), the Supreme Court relied on English common law regarding jus soli to inform the meaning of “citizen” in the Fourteenth Amendment as well as the natural-born–citizenship requirement of Article II, and noted that any right to citizenship thoughjus sanguinis was available only by statute, and not through the Constitution. Notwithstanding the Supreme Court’s discussion in Wong Kim Ark, a majority of commentators today argue that the Presidential Eligibility Clause incorporates both the common-law and English statutory principles, and that therefore, Michigan Governor George Romney, who was born to American parents outside of the United States, was eligible to seek the Presidency in 1968.

Sparks fly as campaigns dump RNC, take control of debates

Chairman Reince Priebus and the Republican National Committee received a pink slip and a stinging rebuke from the candidates’ campaigns Sunday over its mishandling of the first three debates.

The campaigns decided that the RNC will no longer be in control of negotiations after a two-hour meeting at an Alexandria, Va. Hilton, Politico reported Sunday.

Priebus tried to stop the revolt by penning a stern letter to NBC and cancelling an upcoming partnership with Telemundo in February 2016, but it turned out to be too little too late. In the wake of the CNBC debate, which was widely seen as a debacle, pitting hostile, liberal moderators against the candidates, the campaigns had had enough.

Gail Gitcho, spokeswoman for Gov. Bobby Jindal and one of the meeting’s organizers, said she thought the meeting was productive, agreeing that “campaigns will now assume negotiation of format instead of the RNC.”

Some sparks flew between Jeb Bush’s and Donald Trump’s campaigns over the fate of the Telemundo debate.  Danny Diaz, Bush’s campaign manager, said he wanted the debate reinstated.

Trump’s manager Corey Lewandowski snapped in reply “We don’t want that,” according to a person present at the meeting. “We won’t go.”

Among the items the campaigns agreed to are a two-hour time limit, 30 second opening and closing statements, and some control over the graphics the networks are allowed to use during debates.  CNBC displayed a graphic during the last debate listing Bush’s past work as a financial consultant, while omitting his eight-year tenure as Florida governor.

The campaigns didn’t agree on how many candidates should be on stage at one time, with the lower-polling candidates pushing for inclusion on the main stage. Current frontrunner Ben Carson’s campaign also supported that, but the other top-polling campaigns did not agree.

#Clinton Cash Connections Exposed – New Docs Raise Questions on Clinton Conflicts of Interest

The Clinton email scandal is serious enough.  Nonetheless, it is useful to remember what exactly Mrs. Clinton was trying to hide before our litigation forced the disclosure of her separate email system.  You can bet that the cover up of the depth of her abuse of office for private gain is one thing about which she does not want you to know the full truth.

Judicial Watch is in the lead in uncovering these Clinton cash abuses.

This week, we released 789 pages of State Department “ethics” review documents concerning former Secretary of State Hillary Clinton, revealing that at least one speech by Bill Clinton appeared to take place without the required State Department ethics approval.  The documents also include a copy of Bill Clinton’s draft consultant agreement with Laureate Education, Inc., which was submitted for ethics review by the State Department.  But the State Department redacted the information regarding compensation and the specific services Bill Clinton was hired to provide to the controversial “for profit” education company.  The documents were released as a result of a federal court order in our history-making Freedom of Information Act (FOIA) lawsuit filed against the State Department on May 28, 2013, (Judicial Watch v. U.S. Department of State (No. 1:13-cv-00772)).

The documents include heavily redacted emails from 2009 about the review of a speech Bill Clinton was set to give to the Institute of Scrap Recycling Industries (ISRI).  An April 1, 2009, email from then-State Department Senior Ethics Counsel Waldo W. “Chip” Brooks notes that the ethics review approval of the speech “was in the hands of Jim [Thessin] and Cheryl Mills.  They were to discuss with Counsel to the former President.  I do not know if either ever did.”

A follow-up September 1, 2009, email to Brooks from a colleague asks, “[W]as there ever a decision on the Clinton request involving scrap recycling?  Below is the last e-mail I have on it – I assume it just died since I don’t’ have an outgoing memoBrooks responds two minutes later: 

“I think the decision was a soft call to Clinton’s attorney and the talk did not take place.  You might want to send an email to [Clinton Foundation Director of Scheduling and Advance] Terry [Krinvic] and tell her that you have a gap in your records because you were gone and wanted to know if the President ever did talk before ISRI?

In fact, Bill Clinton spoke to the scrap recycling group on April 30, 2009, for a reported fee off $250,000

A substantial majority of Republicans want billionaire mogul Donald Trump to stay in the 2016 presidential race, according to a new CNN/ORC poll. He’s the candidate GOP voters are most likely to say they want to see on the debate stage.

Meanwhile, in another poll released Sunday by NBC News, Trump is leading in New Hampshire and second only to Wisconsin Gov. Scott Walker in Iowa.

Together, the polls indicate there is no sign that the Trump juggernaut is slowing down. Both polls are notable because they were the first taken after the flap last weekend when Trump seemed to disparage the service record of Sen. John McCain during a forum in Iowa.

"There is a movement going on. This is more than me," Trump said on CNN's "State of the Union," saying the poll results were not surprising. "People are tired of these incompetent politicians in Washington that can't get anything done."

Among Republicans in the CNN poll, Trump leads with 18 percent support, followed by former Florida Gov. Jeb Bush with 15 percent. Wisconsin Gov. Scott Walker has 10 percent support among Republicans and Republican-leaning independents who are registered to vote. The margin of error is 3.5 percentage points, CNN reported.

Donald Trump leads the pack in a crowded field of 2016 Republican hopefuls — and is now atop a poll in the key primary state of New Hampshire and a close second in Iowa.

The Donald topped an NBC/Marist poll in New Hampshire with 21 percent support, besting Jeb Bush’s 14 percent and Scott Walker’s 12 percent.

In Iowa, Walker claimed 19 percent, but Trump was right behind, at 17 percent, ahead of third-place Bush, with 12 percent.

Nationally, the billionaire real estate developer was backed by 18 percent of Republicans in the CNN/Opinion Research Corporation poll, edging out ex-Florida Gov. Bush, who was at 15 percent, and Wisconsin Gov. Walker, who stalled at 10 percent.
